4. Waiver of Inspection Rights: By participating in this auction, you agree to waive the right of inspection for the property associated with the Assignment of Judgement Foreclosing Rights of Redemption.

5. Government Code Violations: The Assignment of Judgement Foreclosing Rights of Redemption is sold subject to any local, state, or federal government housing code violation notices or vacant house notices.

12. Payment and Transfer: Upon winning the auction, the bidder must pay the full amount of their bid plus the Buyer's Premium or auction service fee within 3 business days of contract ratification. Upon receipt of payment, the Baltimore City's Assignment of Judgement Foreclosing Rights of Redemption will be assigned to the winning bidder.

13. Indemnification: The winning bidder agrees to indemnify and hold harmless Ashland Auction Group and its agents, employees, and representatives from and against any and all losses, damages, liabilities, claims, actions, judgments, costs, and fees (including reasonable attorneys' fees) caused by, relating to, or arising out of the winning bidder's purchase or attempted purchase of the Assignment of Judgement Foreclosing Rights of Redemption.

14.To purchase the tax lien, the Purchaser is responsible for the Total Purchase Price of the Assignment Contract. To complete ownership of the property, Purchaser will be responsible for any outstanding tax sale bid balance and accrued municipal liens due to the jurisdiction after completion of tax lien foreclosure and/or tax sale judgment sale.

15. Limitation of Liability: In no event shall Ashland Auction Group or its agents, employees, or representatives be liable for any indirect, incidental, special, punitive, or consequential damages whatsoever arising out of, resulting from, or in connection with this auction and/or the bidder's use of the auction website, whether based on warranty, contract, tort, or any other legal theory, and whether or not Ashland Auction Group is advised of the possibility of such damages.

16. Force Majeure: Ashland Auction Group shall not be held responsible for any interruption in service, errors, and/or omissions caused by any means and does not guarantee continual, uninterrupted or error-free service or use of the auction website. Bidder acknowledges that this auction is conducted electronically and relies on hardware and software that may malfunction without warning.

17. Transfer of Assignment: Upon receipt of full payment, the Baltimore City's Judgement Foreclosing Rights of Redemption will be assigned to the winning bidder. The transfer will be executed in accordance with the laws and regulations of the State of Maryland. The winning bidder will receive an electronic copy of the assignment at the email address provided during registration. Purchaser shall file the assignment with the Baltimore City's Government.

18. Title and Ownership: The winning bidder acknowledges that the purchase of the Tax Sale Certificate and Judgement Foreclosing Rights of Redemption does not convey title to the property. Buyer must obtain a tax sale deed from the county, based on the already obtained judgment, to obtain ownership of the property.

19. Redemption Rights: The winning bidder agrees to comply with all laws and regulations regarding redemption rights.

20. Legal Compliance: The winning bidder is responsible for complying with all laws and regulations related to the purchase, holding, and enforcement of the Judgement Foreclosing Rights of Redemption. This includes, but is not limited to, laws regarding tax collection, interest rates, redemption rights, foreclosure, and eviction.

1. Auction Platform: This online auction will be held on www.ashlandauction.com. By participating in this auction, you agree to abide by these terms and conditions, as well as any other terms and conditions set forth on the Ashland Auction Group website.

2. Property: The Assignment of Judgement Foreclosing Rights of Redemption for sale is for the property located at 1834 Brunt St. Baltimore, MD 21217

3. As-Is Condition: The Assignment of Judgement Foreclosing Rights of Redemption is sold in "AS IS" condition, without express or implied warranty as to the nature and description of the improvements as contained herein; and subject to easements, agreements, restrictions, or covenants of record affecting the same.

4. Waiver of Inspection Rights: By participating in this auction, you agree to waive the right of inspection for the property associated with the Assignment of Judgement Foreclosing Rights of Redemption.

5. Government Code Violations: The Assignment of Judgement Foreclosing Rights of Redemption is sold subject to any local, state, or federal government housing code violation notices or vacant house notices.

11. Buyer's Premium: There will be a 10% Buyer's Premium or a $1,000 auction service fee, whichever is greater, added to the high bid. This fee is in addition to the winning bid amount and must be paid in full at the close of the auction. If, at a later date, there is a tax sale redemption, the Buyer’s Premium is nonrefundable. If the Certificate sells above face value and there is tax sale redemption, there will be no refund of the difference between the face value and purchase price.

12. Payment and Transfer: Upon winning the auction, the bidder must pay the full amount of their bid plus the Buyer's Premium or auction service fee within 24 hours of contract ratification. Upon receipt of payment, the Baltimore City's Assignment of Judgement Foreclosing Rights of Redemption will be assigned to the winning bidder.

13. Indemnification: The winning bidder agrees to indemnify and hold harmless Ashland Auction Group and its agents, employees, and representatives from and against any and all losses, damages, liabilities, claims, actions, judgments, costs, and fees (including reasonable attorneys' fees) caused by, relating to, or arising out of the winning bidder's purchase or attempted purchase of the Assignment of Judgement Foreclosing Rights of Redemption.

14.To purchase the tax lien, the Purchaser is responsible for the Total Purchase Price of the Assignment Contract. To complete ownership of the property, Purchaser will be responsible for any outstanding tax sale bid balance and accrued municipal liens due to the jurisdiction after completion of tax lien foreclosure and/or tax sale judgment sale.

15. Limitation of Liability: In no event shall Ashland Auction Group or its agents, employees, or representatives be liable for any indirect, incidental, special, punitive, or consequential damages whatsoever arising out of, resulting from, or in connection with this auction and/or the bidder's use of the auction website, whether based on warranty, contract, tort, or any other legal theory, and whether or not Ashland Auction Group is advised of the possibility of such damages.

16. Force Majeure: Ashland Auction Group shall not be held responsible for any interruption in service, errors, and/or omissions caused by any means and does not guarantee continual, uninterrupted or error-free service or use of the auction website. Bidder acknowledges that this auction is conducted electronically and relies on hardware and software that may malfunction without warning.

17. Transfer of Assignment: Upon receipt of full payment, the Baltimore City's Judgement Foreclosing Rights of Redemption will be assigned to the winning bidder. The transfer will be executed in accordance with the laws and regulations of the State of Maryland. The winning bidder will receive an electronic copy of the assignment at the email address provided during registration. Purchaser shall file the assignment with the Baltimore City's Government.

18. Title and Ownership: The winning bidder acknowledges that the purchase of the Tax Sale Certificate and Judgement Foreclosing Rights of Redemption does not convey title to the property. Buyer must obtain a tax sale deed from the county, based on the already obtained judgment, to obtain ownership of the property.

19. Redemption Rights: The winning bidder agrees to comply with all laws and regulations regarding redemption rights.

20. Legal Compliance: The winning bidder is responsible for complying with all laws and regulations related to the purchase, holding, and enforcement of the Judgement Foreclosing Rights of Redemption. This includes, but is not limited to, laws regarding tax collection, interest rates, redemption rights, foreclosure, and eviction.

21. Legal Disputes: In the event of any misunderstanding or disagreement, the parties all mutually agree to binding arbitration by an agreed upon mediator in the State of Maryland.

TERMS OF SALE:  A deposit in the amount of Seven Thousand Dollars ($7,000.00), payable in cash, certified check, or other form acceptable to the Substitute Trustee, in the Substitute Trustee’s sole and absolute discretion, will be required of the purchaser(s) at the time and place of sale.  The deposit must be increased to 10% of the purchase price within two (2) business days, and delivered to the office of the Auctioneer in the same form as the initial deposit.  The balance of the purchase price shall be due in cash or by certified check with interest on the unpaid balance of the purchase price at the rate of ten percent (10%) per annum from the date of sale to and including the date of settlement.  In the event the Noteholder, or an affiliate thereof, is the successful bidder at the sale, such party will not be required to make a deposit or to pay interest on the unpaid purchase money.  Taxes, water rent/charges, ground rent, if any, and all other municipal charges and liens owed against the Property shall be the sole responsibility of the purchaser(s) and shall be paid by the purchaser(s) at settlement.  In addition, all other charges, expenses and liens owed against the Property including, but not limited to, all condominium fees and expenses and public charges and assessments owed against the Property and payable on an annual basis, such as sanitary and/or metropolitan district charges, if any, shall also be the responsibility of the purchaser(s) and shall be paid by the purchaser(s) at settlement.  The Substitute Trustee reserves the right to reject any and all bids, and to extend the time for settlement, if applicable.  In the event any taxes or other municipal charges have been prepaid, such amounts shall be adjusted as of the date of the foreclosure sale.

The Property will be sold in an "AS IS" condition and without any warranties or representations, either express or implied, as to the nature, condition or description of the improvements.  In addition, the Property will also be sold subject to all existing housing, building and zoning code violations, and any receivership action arising therefrom, subject to all critical area and wetland violations, subject to all environmental problems and violations which may exist on or with respect to the Property, and subject to all matters and restrictions of record affecting the same, if any.  The purchaser(s) at the foreclosure sale shall assume the risk of loss for the above-referenced Property immediately after the sale takes place. The Property will be sold subject to all of the following that are not extinguished as a matter of law by the foreclosure sale:  all easements, conditions, liens, restrictions, rights of redemption, covenants, encumbrances, ground rents, ground leases, such state of facts that an accurate survey or physical inspection of the Property might disclose, and agreements of record affecting the same, if any.

The purchaser(s) shall pay all documentary stamps, state and local transfer taxes, recordation taxes and fees, title examination costs, attorneys’ fees, conveyance fees and all other incidental settlement costs.  The purchaser(s) shall settle and comply with the sale terms within twenty (20) days following the final ratification of sale by the Circuit Court for Baltimore City, Maryland, unless said period is extended by the Substitute Trustee for good cause shown.  Time is of the essence.

In the event the purchaser(s) fails to go to settlement as required, in addition to any other legal or equitable remedies available, the Substitute Trustee may, without further order of the court, declare the aforementioned deposit forfeited and resell the Property at the purchaser’s sole risk and expense.  In such event, the defaulting purchaser(s) shall be liable for the payment of any deficiency in the purchase price, all costs and expenses of both sales, reasonable attorneys’ fees, all other charges due, and incidental damages.  The parties’ respective rights and obligations regarding the terms of sale and the conduct of the sale shall be governed by and interpreted according to the laws of the State of Maryland.

If the Substitute Trustee is unable to convey the Property as described above, the purchaser(s)' sole remedy at law or in equity shall be limited to the refund of the aforementioned deposit, without interest thereon.  Upon refund of the deposit to the purchaser(s), the sale shall be void and of no effect, and the purchaser(s) shall have no further claim against the Substitute Trustee or the Noteholder.
